Wrongful death cases require parties to deal with raw emotions. It is our view that counsel, adjusters, risk managers, and mediators must all be informed not only about the facts of a wrongful death case but also about the special issues survivors deal with in their bereavement.

It is difficult to know where to start in this short discourse. However, the beginning for me, as a transformative mediator, is with the world view. American Indian people hold a relational world view. Their spirituality, in most forms, identifies a strong connection to other human beings, or at least to all tribal members or Indians, and the life force of the earth.

This article explores the forces that make mediation a preferred method of dispute resolution in business disputes, a survey of various nations' systems of justice, including China and India, and an analysis of the ripeness of all nations to embrace negotiation and peace making. Economic self interest and necessity will continue to influence the trend toward building mediation into agreements, and seeking mediation prior to instituting other dispute resolution processes.
