The X factor in mediation is the ability to influence the other side to pay more or take less. Finding this elusive factor is the challenge for most mediators and often takes place in the face of uncertainty. This uncertainty takes many forms and can serve as a barrier if not acknowledged and addressed by the parties.

You may quote me on this: Mediation needs to get closer to a ‘top of mind’ status with consumers if we are to accelerate the development of our profession and to accomplish more positive effect, sooner than later, in service to our culture. To do that, we need to invest ourselves in the marketing of our profession and more broadly and thoroughly deliver the message about the alternatives for conflict resolution we bring to the market places we serve.

Does a mediator need a heart? Is it possible to cultivate the heart as an organ of perception and understanding? I suggest it is not only possible but also absolutely necessary. Even the most hard-boiled “mentals” will notice the difference even if they cannot quite explain what it is.
